Terms of Use for Exclusive Designs and Digital Products
LICENSE AND INTELLECTUAL PROPERTY NOTICE
All exclusive designs and digital embroidery design files available on Etsy (collectively, "the Works") are the sole and exclusive intellectual property of Garden Folly Fine Linens™ and are protected under applicable copyright law.
Grant of License: Upon purchase, the buyer ("Licensee") is granted a limited, non-exclusive, non-transferable license to reproduce the Works by means of physical stitching on finished goods for personal use or for resale through retail channels at the point of sale to end consumers.
Restrictions: Notwithstanding the foregoing, the Licensee expressly acknowledges and agrees that the Works may NOT be sold, sublicensed, shared, traded, transferred, reproduced in digital or other non-stitched form, altered, or exchanged in any manner. Furthermore, the use of the Works on finished goods intended for wholesale distribution — whether sold directly by the Licensee or through any third-party wholesale intermediary — is strictly prohibited.
Scope of Permitted Use: The license granted herein is limited exclusively to personal use applications and retail sale to end consumers. Any use beyond this scope constitutes a material breach of this Agreement and may give rise to claims under applicable intellectual property and contract law.
Acceptance of Terms: By completing a purchase of any exclusive design or digital product from the Garden Folly Fine Linens website, the Licensee acknowledges that they have read, understood, and agreed to be bound by the terms and conditions set forth herein.
